IT-2104 Employee's Withholding Allowance Certificate
WHO SHOULD FILE THIS FORM: This certificate, Form IT-2104, is
completed by an employee and given to the employer to
instruct the employer how much New York State (and New York
City and Yonkers) tax to withhold from the employee’s pay.
The more allowances claimed, the lower the amount of tax
withheld.

Certificate of Exemption from Withholding
WHO QUALIFIES: You may claim exemption from
withholding for New York State personal income tax if: GROUP A: (1) you are under age 18, over age 65, or a
full-time student under age 25, and (2) you did not have a New York
income tax liability for 2010, and (3) you did not expect to have a New York income tax liability for 2011 (for this purpose, you have a tax liability if
your return shows tax
before the allowance of any credit for income tax withheld.) GROUP B: you meet the conditions set forth under the Servicemembers Civil Relief Act (SCRA), as amended by the Military Spouses Residency Relief Act.
